Terms of Service

• Eligibility: You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or legal guardian’s permission to use the Service.
• Account: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Permitted Use: You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for any photos you upload and any customizations you request.
• Prohibited Conduct: You agree not to:
  • Upload photos that are illegal, obscene, defamatory, threatening, harassing, hateful, or racially or ethnically offensive.
  • Upload photos that infringe upon any third party's rights, including privacy, publicity, copyright, trademark, or other intellectual property rights.
  • Use the Service to create content that promotes violence, discrimination, or illegal activities.
  • Attempt to disrupt or interfere with the Service, its servers, or networks.
  • Use any automated means, such as bots or scrapers, to access the Service or collect content.

• Your Uploaded Photos ("User Content"): You retain all ownership rights to the photos you upload to the Service. By uploading a photo, you represent and warrant that you have all necessary rights and permissions to do so and to grant us the license described below.
• License to Us for User Content: You grant CaricatureMe a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify (e.g., for technical purposes like cropping or resizing for AI processing), create derivative works (solely for the purpose of generating your caricature), communicate, publish (only if you make it public), publicly perform, publicly display, and distribute your User Content solely for the purposes of operating, providing, improving, and promoting the Service. This license ends when you delete your User Content or your account, except to the extent your content has been shared with others and they have not deleted it, or for our internal service improvement purposes on an anonymized basis.
• Generated Caricatures ("Generated Content"): Subject to your rights in your User Content, you own the specific, unique caricature images created for you by the Service.
• CaricatureMe's Rights: We reserve the right (but not the obligation) to review and remove User Content or Generated Content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable. We may also use anonymized or aggregated User Content and Generated Content for research, analytics, and to improve our AI models and Service.
• Service IP: The Service itself, including its "look and feel" (e.g., text, graphics, images, logos, page headers, button icons, and scripts), proprietary content, information and software, and any other intellectual property rights related thereto, are and will remain the exclusive property of CaricatureMe and its licensors.

• Tokens: Certain features, such as generating caricatures, require "Tokens." Tokens can be obtained through one-time purchases or as part of a subscription plan.
• Subscriptions: Subscription plans may offer a recurring allowance of Tokens and potentially other benefits. The specific terms of any subscription, including billing frequency, renewal, and cancellation policies, will be presented to you at the time of purchase and are managed through our third-party payment processor, Stripe.
• Payments: All financial transactions are processed via Stripe. By making any purchase, you agree to Stripe's terms and privacy policy.
• Refunds: Generally, all purchases of Tokens and subscription fees are final and non-refundable, except where required by applicable law or as explicitly stated otherwise in a specific offer. If a generation fails due to a technical fault on our end or a content policy violation flagged by our AI provider for which tokens were deducted, we may, at our discretion, issue a refund of tokens for that attempt.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason, including for maintenance or upgrades.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms, or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

CaricatureMe DOES NOT WARRANT THAT: A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE (INCLUDING THE GENERATED CARICATURES) WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

OUR AI MODELS ATTEMPT TO CREATE ARTISTIC AND ENTERTAINING CARICATURES. WE DO NOT GUARANTEE THE LIKENESS, ACCURACY, APPROPRIATENESS, OR QUALITY OF ANY GENERATED CONTENT. THE INTERPRETATION AND USE OF GENERATED CONTENT ARE AT YOUR SOLE DISCRETION AND RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CaricatureMe, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice prior to any new terms taking effect by posting on our website or sending an email notification. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
